Beijing Municipal Commission of Housing and Urban-Rural Development released on 13 January that from then on, unauthorized change of main architectural structure and bearing structure would be punished severely. Beijing Municipal Commission of Housing and Urban-Rural Development and Beijing Municipal Public Security Bureau jointly issued “The Notice on Reinforcement of the Supervision and Enforcement of Acts in Violation of the Regulations on Unauthorized Change of Main Architectural Structure and Bearing Structure”, publicly proclaiming that decoration workers are forbidden to change the main architectural structure and bearing structure of a building without authorization in their decoration and decoration activities. In case that the main architectural structure and bearing structure of a building have undergone unauthorized changes but received no restoration, the Housing Registration Department will record the changed parts on the housing registration book and inform the transferee upon house transfer registration.

It is reported that if it is certified that lessees have changed the main architectural structure and bearing structure of a building, the administrative departments of Beijing Municipal Commission of Housing and Urban-Rural Development will impose punishment in accordance with the law and order them to make correction within a given period of time, if they have made the building unsafe, caused other heavy losses, endangered the public security or may have committed crimes, they will be handed over to public security organs for disposal. Furthermore, lessees have to assume all accrediting and restoration fees besides paying a penalty of 50,000 Yuan to 100,000 Yuan.

Zhang Nongke, deputy director of Beijing Municipal Commission of Housing and Urban-Rural Development, said that the shared parts of houses should be jointly managed. When two or more than two owners shared houses with a contiguous structure, they also jointly possessed the main architectural structure and bearing structure of the houses and had the co-management right. Once one owner changed the main architectural structure and bearing structure without authorization in his decoration and decoration, the owner whose right was infringed or the owners committee could proceed against him in court in accordance with relevant regulations and require him to stop infringement, eliminate danger, abate nuisance and compensate for losses.

It is said that since decoration and fitment takes place indoor, problems are “difficult to find out”. As a result, besides the patrol of the property management company, any unit or individual could directly report to the house management authorities or call the complaint hotline of the construction authorities in relevant district or county.

It is reported that it often takes place in Beijing that the main architectural structure and bearing structure of houses are changed without authorization and thus affect the overall structural safety of houses. This gives rise to many potential safety hazards and endangers the legitimate interest of other owners. From now on, construction authorities in Beijing at all levels will reinforce its supervision, and meanwhile, decoration companies in violation of the above regulations will be punished.
